Microsoft's Do Not Open Letter

Microsoft (Quote, Chart) has started sending letters to people who have already downloaded the company's Windows source code that was illicitly leaked last week, warning them that such actions are in violation of the law.

The Redmond, Wash.-based maker of the Windows operating system said it also has placed alerts on several peer-to-peer clients where such illegal sharing of the leaked source code has taken place. The alerts are designed to inform any user who conducts specific searches on these networks to locate and download the source code that such activity is illegal, the company said.

One thing I don't understand is, why is it assumed that the source code is copyrighted?

Don't you have to publish something for it to be copyrighted? As I understand it, that is a requirement, the idea being that once the copyright expires[*] the works become public domain, which to be at all useful the works need to be publicly available. To that end, it used to be necessary to file works with the copyright office, though that is no longer a requirement. But the principle still holds, doesn't it?

I'm no IP lawyer, but... shouldn't this source code fall under trade secret law instead of copyright law?

[*] Yes I know copyright doesn't expire anymore due to lawmakers repeatedly extending copyrights at the behest of the big media cartels.

Steven Den Beste has a piece of software that gets him around the Washington Post's new registration system ("Register now! It's free and it's required!" it says--yeah, there's a winning slogan.)

I can't be arsed to do the software thing. So I always sign up with incorrect information. I usually choose the first option in any drop down list. (Yes, I'm a CEO doing admin support *g*) I'll put I was born in 1900 and my zip code is always 90210.

If anyone wants to piggybank on my made up info, the login is blogreader@aol.com, password blogreader.

Am I the only person who tries to sabatage the registers?

I don't think I have come across anything like this..
with maybe an exception in 'croc~thing' ..
